Terms of Service

These Terms of Service (“Terms”) govern your use of the website buildmillennium.com and any engagement with Millennium Custom Home Building, LLC (“Millennium,” “we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Scope of Services
All work performed by Millennium Custom Home Building is governed by:
• Approved plans and specifications signed off by the client
• Executed agreements, proposals, or accepted written estimates
• Applicable building codes, permitting requirements, and Arizona state regulations
No work will begin outside of a written and authorized scope of work.
2. Estimates and Pricing
All estimates reflect current scope and prevailing market conditions at the time of issuance. Pricing is subject to change due to:
• Material cost fluctuations or supply chain disruptions
• Changes in site conditions discovered during the course of work
• Client-requested scope revisions
Unless otherwise stated in writing, estimates are valid for 30 days from the date of issuance. After this period, Millennium reserves the right to revise pricing prior to executing a formal agreement.
3. Payment Terms
Payment obligations are defined in each individual project agreement or invoice. The following general terms apply:
• A deposit is required prior to procurement of materials or scheduling of labor
• Payments must be made through verified channels only (see Section 9 – Security)
• Work may be suspended without liability to Millennium in the event of non-payment
• Disputed invoices must be raised in writing within 5 business days of receipt
4. Change Orders
No deviation from the approved scope of work will proceed without:
• A written change order signed by both parties
• Agreement on associated cost adjustments
• Agreement on any impact to the project timeline
Verbal authorizations are not binding. Unauthorized work performed at a client’s direction without a signed change order may not be compensable.
5. Project Variables and Timeline
Project timelines are estimates based on anticipated conditions. Millennium is not liable for delays caused by:
• Weather events or environmental conditions
• Material availability or supply chain disruptions
• Permitting delays or inspection scheduling by government agencies
• Unforeseen site conditions (e.g., subsurface issues, hidden structural conditions)
• Client-requested changes or decisions that delay the schedule
Where delays arise, Millennium will notify the client promptly and provide a revised timeline estimate.
6. Communication and Approvals
Email is the official and controlling form of communication for all project-related matters. The following standards apply:
• Formal approvals, scope changes, and authorizations must be confirmed in writing
• Phone and SMS communications are used for coordination only and do not constitute binding approvals
• All communications, documents, and attachments are considered confidential and intended solely for the designated recipient(s)
Millennium reserves the right to monitor and retain electronic communications as permitted by applicable law for operational, legal, and quality control purposes.
7. Third-Party Involvement
Projects may involve licensed subcontractors, vendors, and material suppliers. Millennium will:
• Share only the information necessary for project execution
• Maintain reasonable oversight of third-party work
Millennium does not control the internal policies or practices of third-party subcontractors and suppliers, and is not responsible for their independent acts or omissions outside the scope of project coordination.
8. Limitation of Liability
To the fullest extent permitted by Arizona law:
• Millennium is not liable for delays, losses, or damages arising from causes outside its reasonable control, including weather, supply chain disruptions, permitting delays, or unforeseen site conditions
• All services are performed in accordance with industry standards and applicable Arizona building codes and regulations
• Warranty terms, if applicable, are defined expressly in the applicable project agreement. No implied warranties are extended beyond those required by law
• In no event shall Millennium’s total liability exceed the total amount paid by the client under the applicable project agreement
9. Security and Payment Verification
Millennium implements reasonable safeguards to protect communications and financial transactions. Clients are responsible for:
• Verifying the authenticity of payment instructions before remitting funds
• Confirming any change in payment instructions directly by phone using a known contact number before acting
Millennium is not responsible for losses resulting from fraudulent payment redirection schemes or malicious content introduced outside our control. If you receive unexpected or changed payment instructions, contact us immediately at privacy@buildmillennium.com before taking action.
10. Governing Law and Dispute Resolution
These Terms, and any disputes arising from or related to your engagement with Millennium Custom Home Building, shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. Both parties consent to personal jurisdiction in those courts.
Prior to initiating formal legal proceedings, the parties agree to attempt to resolve disputes in good faith through direct negotiation. If negotiation fails, the parties may agree to pursue mediation before resorting to litigation.
11. Misdelivery Protocol
If you receive communication from Millennium in error:
• Delete the message immediately
• Notify us at privacy@buildmillennium.com
• Do not copy, forward, or distribute the contents
